Supreme Court of Canada extends CGL insurers' duty to defend

| In late September 2010 the Supreme Court of Canada released a major decision affecting insurers and the construction industry in Progressive Homes Ltd. v. Lombard General Insurance Co. of Canada. The decision reverses the direction of the British Columbia courts for the last 10 years, bringing insurance coverage analysis in this province into line with other Canadian provinces and the United States, and greatly extending insurers' duty to defend under Commercial General Liability (CGL) Policies for construction defects. |
